The ACLU of Nebraska is expanding capacity, specific to protecting and defending LGBTQIA+ rights, in our sophisticated program of integrated advocacy to fight back against broad attacks on civil liberties while continuing to vigorously move our mission forward. Our goals are both resistance and progress. Our vision is a state where LGBTQIA+ Nebraskans can live openly; where identities, relationships, and families are respected; and where fair treatment is not dependent on who you are or whom you love. Our goal is to end discrimination based on sexual orientation and gender identity in employment, schools, and public accommodations in Nebraska because it is wrong and hurts us all. This new position will help us manage increased legal intakes, support our litigation docket, develop new cases, conduct Know Your Rights trainings to legal and community audiences, conduct legal research, and work in close collaboration with senior staff to support and expand our policy program.
The ACLU of Nebraska is the state affiliate of the national ACLU, a nonpartisan public interest civil rights organization dedicated to the defense and expansion of civil liberties and civil rights through litigation, policy advocacy and public education. In recent years, our litigation program has struck down the state defense of marriage act, abolished the ban on gay and lesbian foster parents, secured the right to marry for those who are incarcerated, settled excessive force cases to reform police practices, and scored legal victories for voting rights and free speech. Our policy program has scored victories to abolish the death penalty, to enact smart criminal justice reforms, and to protect women’s health and women’s rights. Our community education program conducts over a hundred events annually to thousands of Nebraskans statewide, empowering all Nebraskans to know and understand their rights.
Our offices are in the heart of Nebraska’s capital city, Lincoln, Nebraska. Our 8-person staff is complemented by a contract lobbyist, law clerks, dozens of volunteer attorneys, and thousands of supporters statewide. The LGBTQIA+ legal and policy counsel will report directly to the Legal Director. Responsibilities include assistance with legal intakes, legal research, strong effective and ethical client counseling, drafting, administrative advocacy, discovery and motion practice, and assistance with trials and appeals. The legal and policy counsel will assist with community education events, empowering groups, and individuals to know their rights. The legal and policy counsel will conduct and supervise policy research projects with clerks and interns. The legal and policy counsel will help implement the ACLU of Nebraska’s ambitious legislative agenda utilizing appropriate strategies and tactics at Nebraska’s Unicameral Legislature and entities of local government in consultation with senior staff. The legal and policy counsel will participate in policy-related coalitions and meetings. The legal and policy counsel will attend various ACLU functions and handle other projects as assigned. The legal and policy counsel must have the ability to work occasional evenings and weekends to facilitate community outreach and possess a willingness to attend meetings and events throughout the state, with an emphasis in the Omaha area.
Must be admitted to practice law in Nebraska or eligible for admission. Previous experience in constitutional law and litigation is a plus. Must have excellent problem-solving skills; ability to juggle multiple ongoing projects and exercise good judgment in stressful situations; a commitment to upholding the highest ethical ideals of the legal profession, and ability to affirmatively file cases independently and collaboratively to address civil rights violations. Must have superior writing, research, and verbal skills in presenting both to lawyers and the public; possess leadership and organizational skills to engage cooperating lawyers and work on complex cases; and the ability to take initiative and work strategically. Must demonstrate a strong commitment to civil rights and civil liberties.

Compensation and Benefits
Salary range is generally $65,000-$75,000 and compensation is based on experience. Excellent benefits include vacation, sick leave, and parental leave, generous health, dental, and vision insurance with employee and family premiums paid 100% by the employer, a 401k match, cell phone reimbursement, and paid parking.
