We are seeking a Product Counsel to join our growing Product and Commercial Legal team to meet the expanding needs of our company and our customers.  In this role, you will be advising and working collaboratively within our Gusto Embedded Payroll division to support the risk-adjusted development and sale of Gusto’s payroll offering as an embedded service (infrastructure-as-a-service).  If you’re looking to roll up your sleeves and dive in with product managers, engineers, and business development leaders who are passionate about novel and creative ways of serving customers with Gusto’s award-winning payroll engine, this is the role for you!  Our Gusto Embedded Payroll solution has been adopted by a wide range of customers, from  young fintechs fresh out of Y Combinator to established national banking and credit institutions.  There is no challenge too big or too small for our Gusto Embedded Payroll team and you will be right alongside them driving results and helping them test the limits of what is possible.

This role can be based in the San Francisco, Denver, or New York City metro areas.

Here’s what you’ll do day-to-day:

  • Look around corners, creatively solve problems, and help define business strategy as Gusto expands its product functionality in this new, embedded format, meeting the needs of small businesses but also other companies who want to create and sell their own payroll offering, powered by Gusto. 
  • Counsel the product, engineering, design, and business teams and help them navigate a range of issues related to our products and/or partnerships as we translate them into an infrastructure-as-a-service package.  This includes assessment and solutioning of  employment and wage & hour experiences, payments risk, data privacy, and tax.
  • Contribute to the development of scalable processes to manage legal risk and accelerate product expansion.
  • Partner closely with our commercial counsel team to advise on product risk, work through redlines, and negotiate with counterparties.

Here’s what we're looking for:

  • JD degree and a member of a State bar/ active license to practice law.
  • 6-8+ years of combined legal experience, with experience working in an in-house legal department at a B2B SaaS company.
  • Experience supporting enterprise sales teams (B2B). 
  • Demonstrated ability to build consensus and build strong relationships. 
  • A builder mindset.
  • Experience launching and scaling highly regulated products.
  • A team player mindset (no job is too big or too small).
  • Demonstrated success in working collaboratively to help business clients understand and own risk-based decisions. 
  • Experience creatively solving problems, balancing legal risk and business needs.
  • Attention to detail and the ability to follow through in a fast-paced environment.
  • A collaborative approach and demonstrated ability to work well under pressure, cross-functionally, and independently.
  • Experience in working closely with commercial or contracts counsel to support deal closure.
  • Comfortable in navigating novel questions/living in the gray to support a high volume sales team.

Our cash compensation amount for this role is targeted at $156,000 - $194,000/year in Denver and $190,000 - $236,000/year in San Francisco and New York.


Gusto has physical office spaces in Denver, San Francisco, and New York City. Employees who are based in those locations will be expected to work from the office on designated days approximately 2-3 days per week (or more depending on role). The same office expectations apply to all Symmetry roles, Gusto's subsidiary, whose physical office is in Scottsdale.

Note: The San Francisco office expectations encompass both the San Francisco and San Jose metro areas. 

When approved to work from a location other than a Gusto office, a secure, reliable, and consistent internet connection is required.
