Antecedentes Generales 

 

ProIntegridad es un proyecto de cooperación técnica, financiado por la Agencia de los Estados Unidos para el Desarrollo Internacional (USAID), que busca contribuir a generar un entorno de negocios e inversión más justo, integro y competitivo en México a través del diseño y adopción de estándares y prácticas de transparencia e integridad. El Proyecto pretende alcanzar su objetivo general mediante actividades de asistencia técnica, capacitación y comunicación. ProIntegridad es implementado por Dexis Consulting Group.

Contexto.  

 

Prointegridad colabora con el Municipio de San Pedro Garza García de Nuevo León en acciones encaminadas a fortalecer la transparencia y la integridad en los procesos de comparas públicas del municipio. La normativa del estado de Nuevo León no establece la responsabilidad penal de empresas que participan en actos de corrupción, por lo que no está alineada a la normatividad penal federal. Es de interés del Municipio de San Pedro impulsar su incorporación en la normatividad local.  

 

Objetivo de la Consultoría 

 

Elaborar una propuesta de reforma al código penal del estado de Nuevo León, que incluya exposición de motivos y argumentos técnico-jurídicos sobre la relevancia y viabilidad para incorporar la responsabilidad penal de empresas que participan en actos de corrupción en la normatividad local 

 

Actividades y Entregables 

 

La persona que resulte seleccionada para la consultoría será responsable de ejecutar las siguientes tareas bajo la supervisión del personal del Proyecto:  

 

A. Asistencia Técnica  

 

  1. Redactar la propuesta de artículos en materia de responsabilidad penal de personas jurídico-colectivas relacionadas con actos de corrupción. El articulado propuesto deberá estar en armonía con la normativa penal estatal (especialmente con el Código Penal del Estado de Nuevo León) y nacional. Entregable: Documento con propuesta de reforma del código penal.
  2. Elaborar una propuesta de exposición de motivos con argumentos técnicos sobre la idoneidad de la propuesta. Entregable. Documento de 5-8 páginas.
  3. Participar en presentaciones públicas con el objetivo de explicar el contenido de la propuesta y los argumentos técnicos.
  4. Atender las recomendaciones y resolver las dudas sobre el contenido de la propuesta de la contraparte y de ProIntegridad 

 

B. Actividades complementarias  

 

  1. Coadyuvar en la organización de reuniones de trabajo, eventos y actividades relacionadas con la asistencia técnica. 
  2. Dar seguimiento a los acuerdos con el personal de ProIntegridad y contraparte.  
  3. Informar sobre el avance de las actividades y sostener comunicaciones periódicas con el personal del Proyecto. 

 

Perfil requerido 

 

  1. Contar con título de posgrado en Derecho o áreas afines y tener al menos 15 años de experiencia laboral. 
  2. Amplia experiencia en la responsabilidad penal de las empresas, litigio de derecho penal, en la elaboración de propuestas legislativas y argumentación jurídica.
  3. Se valorará experiencia específica en el estado de Nuevo León sobre su normativa y procesos legislativos. 
  4. Competencia para producir material analítico por escrito de alta calidad.  
  5. Iniciativa propia y capacidad para trabajar de forma independiente y/o en equipo, según se requiera, de acuerdo con las fechas límites establecidas y en comunicación cercana con personal de Proyecto.
