The Opportunity

Acquires and reviews all relevant documents from the appropriate public records (for example, clerk of court, property appraiser, tax collector, PATRIOT ACT database, PACER system), maps, surveys, title chains, prior title policies (exact and/or inexact) and related items affecting one or more parcels of land, based on results of this examination, prepares title insurance commitments, pro forma policies, owners and encumbrance reports, plat certificates and title chains in accordance with generally accepted underwriting principles as supplemented by NATIC requirements and standards. Residential Title Examiner shall provide support and back-up for the Commercial Title Examiners at NATIC. 

Principal Duties and Responsibilities

  • Conducts title search and examination incident to the preparation of title insurance products utilizing a variety of media and sources pertinent to the geographic locale (Florida)
  • Extracts the title search results and compiles them into a chain of title for each title examination to be conducted
  • Examines all instruments in the chain of title to determine the adequacy and legal sufficiency thereof, including but not limited to deeds, grant deeds of trust, easements, mortgages, codes, covenants conditions and restrictions, deed assignments, condominium and homeowners association declarations, judgements, liens, and other documents
  • Conducts property tax searches to determine the status of paid and unpaid taxes affecting the parcels, as well as any additional ancillary searches required to complete the search (for example, PATRIOT ACT searches, PACER searches, etc.)
  • Prepares commitments, pro forma polices, endorsements, and owner’s and encumbrance reports based on title search and examination
  • Reviews data to verify ownership, correct annotation, and proper execution
  • Verifies that legal descriptions are written accurately and are valid for title insurance purposes, and confirms that the title search and examination are complete with respect to the legal description
  • Identifies and custom tailors all specific underwriting requirements for title insurance commitments, including requirements for affidavits for questionable documents, entity authority, and special real property interests based upon generally accepted underwriting principles as supplemented by NATIC requirements and standards
  • Identifies and custom tailors all specific underwriting exceptions for title insurance commitments, based upon generally accepted underwriting principles as supplemented by NATIC requirements and standards
  • Map complex legal descriptions in order to properly identify muniments and encumbrances applicable thereto
  • Works with Chief Underwriting Counsel and various NATIC underwriting counsel for guidance on unusual and/or problematic situations such as back vesting uninsured deeds, prior liens, need for indemnity
  • Coordinates the completion of commitments, policies and endorsements with support staff
  • Communicate with NATIC agents who are in receipt of prepared title products with regards to their questions and concerns, and escalating to underwriting counsel those which cannot be resolved
  • Preparing comprehensive and accurate reports
  • Develop requirements and exceptions for residential commitments using various resources
  • May perform all of the duties of a title searcher including opening files and inputting data, generating data from County records to identify tax payments and status, printing relevant documents and reports, sorting and assembling information, requesting additional documentation from title plants

Education and Experience Requirements:

  • High School Diploma or equivalent required
  • Minimum of 3 years’ experience in Commercial title search and examination, and preparation of title insurance commitments with advanced experience with metes and bounds parcels
  • Must possess strong knowledge of title search and examination for Florida, all counties
  • Must possess strong knowledge of underwriting procedures for Florida
  • Knowledge of additional state underwriting procedures preferred
  • Must possess basic real property law knowledge
  • Good working knowledge of title software and county websites desired
  • Customer orientation and ability to adapt/response to different types of customer needs
  • Excellent organization and time management skills
  • Excellent verbal and writing communication skills required
  • Ability to perform basic math calculations (e.g. split ownership percentages and interest calculations)
  • Proficiency in MS Office and SoftPro (or equivalent productions software), ATIDS, DataTrace, TitlePoint
